RELEASE OF LIABILITY AND TRAINING AGREEMENT
Signee of agreement (“Trainee”) agrees to pay MadLab Performance, LLC (“Company”) the fees set forth in this agreement. Trainee agrees to pay an online training fee. Trainee and Company agree that the personal training fee is a non-refundable fee subject to the terms of this agreement. Trainee agrees to pay the first month of training as a minimum to qualify for the online training program. All personal training agreements are non-proprietary, non-voting, and non-transferable. Trainee agrees to pay such amounts regardless of whether trainee actually uses sessions.
The trainee assumes the sole risk of injury, accident, death, loss, cost or damage to his or her person or property which might arise from the use of Company services. The Trainee further agrees that the Company shall not be liable to the Trainee for any claims, demands, injuries, damages, actions, or causes of action whatsoever to the Trainee’s person or property arising out of or in connection with the use of the services of the Company, including any matter relating to a pre-existing physical condition or impairment. Trainee, his or her heirs, personal representatives, executors, representatives, and assigns do hereby expressly forever release and discharge the Company from all claims, demands, injuries, damages, actions, or causes or action, and from all acts of active or passive negligence on the part of the Company, its servants, agents, or employees.
